Ticketed On Median on W 35th Near Lincoln Tunnel

Postby JustinDiGiulio » Tue Jul 24, 2012 4:00 pm

Walked out to bike around 7PM Tuesday 7/23 to see my bike and about 20 others with bright orange tickets placed proudly on them by some officer who thought he hit the jackpot. $115 & Complainant's Comments: "sidewalk".

I've been parking here for a couple of months. There seems to be literally no options for bikes to park in midtown. Was towed a couple months back for parking on the sidewalk of 38th St between 7th & 8th with no plate. (Had been parking there, everyday, for over a year, Mon-Fri)

I'm going to argue this ticket since I'm technically not on the sidewalk. I'm on an asphalt covered section of a median and there is a designated walking path "sidewalk" on two different ends of the median.

Anyone else ticketed here? Any advice?

Justin

Hi Justin --

I'm very sorry to hear that! While that space has been used by motorcycles for a long time, it isn't legal. That's not to say you shouldn't argue the point!

I also wonder whether we cannot try to lobby Manhattan Community Board #4 to formalize this parking. That won't help you with your ticket now, but it would (if successful) help you in the future.
